CLICKAD is a general partnership registered in Ontario, Canada.

We handle personal information in accordance with applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where applicable.

Please do not submit sensitive personal information through our general website forms unless it is specifically requested and reasonably necessary for the service being provided.

Information collected automatically

When you visit our website, certain technical information may be collected by our website, hosting provider, security technologies and service providers.

Depending on the technologies enabled on the website, this may include:

  • IP address;

We use this information primarily to operate, secure, understand and improve our website and services.

02Contact Forms

When you submit a form on this website, your information is processed through HubSpot, our customer relationship management platform, and protected by Google reCAPTCHA, which may collect device and browsing information to help detect and prevent spam and automated abuse.

Some of your information may be processed or stored outside Canada, including in the United States.

Submitting an enquiry or contact form does not automatically mean that you have agreed to receive ongoing promotional marketing communications from CLICKAD.

Where marketing consent is required, we will obtain it separately or rely on another lawful basis permitted by applicable Canadian law.

You may withdraw your marketing consent at any time using the unsubscribe link in our marketing emails or by contacting services@clickad.ca.

03How We Use Personal Information

We may use personal information to:

  • respond to enquiries and requests;
  • schedule consultations;
  • prepare quotes, proposals and recommendations;
  • communicate with prospective and existing clients;
  • provide and manage our services;
  • manage client and business relationships;
  • provide customer support;
  • maintain appropriate business records;
  • operate and maintain our website;
  • understand website usage and performance;

We will not use or disclose personal information for a materially different purpose without obtaining additional consent where required by law.

04Consent

Where required by law, CLICKAD obtains meaningful consent before collecting, using or disclosing personal information.

The appropriate form of consent depends on the circumstances, the sensitivity of the information and the purposes for which it will be used.

When you voluntarily provide information for an identified purpose, we may use that information for that purpose and other purposes reasonably connected with it, subject to applicable law.

You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice.

Withdrawal of consent may affect our ability to provide a service where the information is reasonably necessary to provide that service.

05Cookies and Similar Technologies

Our website uses or may use cookies and similar technologies necessary for functions such as:

  • website operation;
  • security;
  • spam prevention;
  • form functionality; and
  • remembering preferences.

Where enabled, cookies or similar technologies may also be used for:

  • website analytics;
  • measuring website performance;
  • CRM functionality; and
  • marketing or advertising-related purposes.

Some of these technologies may be provided by third parties.

You may be able to block or delete cookies through your browser settings. Disabling certain technologies may affect how parts of the website operate.

Where consent is required by applicable law for a particular technology or purpose, CLICKAD will seek the appropriate consent.

06HubSpot

CLICKAD uses HubSpot as a customer relationship management and marketing platform.

Information submitted through certain website forms may be transmitted to and processed through HubSpot so that we can:

  • respond to enquiries;
  • manage contacts;
  • manage prospective and existing client relationships;
  • maintain appropriate business records; and
  • communicate with you where permitted.

HubSpot and its service providers may process information using infrastructure located outside Canada.

CLICKAD remains responsible for personal information under its control when that information is transferred to a third-party service provider for processing.

We take reasonable contractual or other measures appropriate to the circumstances to require service providers to provide an appropriate level of protection for personal information.

07Google reCAPTCHA

CLICKAD uses Google reCAPTCHA to help protect our website and forms from spam, abuse and automated activity.

In providing this functionality, Google may process technical information relating to your browser, device, IP address and interaction with the website.

Use of reCAPTCHA is subject to the applicable Google Privacy Policy and Google Terms of Service.

08Marketing Communications

CLICKAD may send commercial electronic communications where you have consented to receive them or where we are otherwise permitted to do so under applicable Canadian law.

Where required, CLICKAD marketing communications will:

  • identify CLICKAD as the sender;
  • provide valid contact information; and
  • include a clear and readily accessible unsubscribe mechanism.

You may withdraw marketing consent at any time by:

  • using the unsubscribe mechanism contained in our marketing emails; or
  • contacting services@clickad.ca.

CLICKAD will process unsubscribe requests without delay and no later than 10 business days after receiving the request where required by Canada’s Anti-Spam Legislation.

Withdrawing from promotional communications does not prevent us from sending communications reasonably necessary for an existing business relationship, enquiry, project, service request or other non-marketing purpose.

09Disclosure of Personal Information

CLICKAD does not sell personal information.

We may disclose personal information to service providers where reasonably necessary for legitimate business purposes, with consent, or where permitted or required by law.

These service providers may assist us with functions such as:

  • website security and spam prevention;
  • analytics where enabled;
  • business administration;
  • accounting;
  • professional advisory services; and
  • technology used to deliver our services.

Service providers are permitted to process information only as reasonably necessary for the relevant function, subject to applicable contractual obligations and law.

We may also disclose information where reasonably necessary or legally required to:

  • comply with applicable law;
  • respond to court orders or lawful government requests;
  • investigate fraud, abuse or security incidents;
  • establish, exercise or defend legal rights; or
  • protect the rights, safety, security or property of CLICKAD, our clients, users or others.

10Processing Outside Canada

Some service providers used by CLICKAD operate infrastructure outside Canada, including in the United States.

Personal information may therefore be transferred to, processed or stored outside Canada.

When information is processed in another jurisdiction, it may be subject to the laws of that jurisdiction and may be accessible to courts, law-enforcement authorities, national-security authorities or other government institutions in accordance with applicable local law.

CLICKAD remains accountable for personal information under its control and takes reasonable measures appropriate to the circumstances when engaging third-party processors.

11Data Retention

CLICKAD retains personal information only for as long as reasonably necessary to:

  • fulfil the purposes for which it was collected;
  • manage client and business relationships;
  • perform contractual obligations;
  • maintain appropriate business, accounting and communication records;
  • resolve disputes;
  • protect legitimate business interests; and
  • comply with applicable legal requirements.

Retention periods vary depending on the nature of the information and why it was collected.

When personal information is no longer reasonably required, CLICKAD will securely delete, destroy or anonymize it as appropriate, subject to applicable legal and operational requirements.

12Accuracy

CLICKAD takes reasonable steps to keep personal information as accurate, complete and up to date as necessary for the purposes for which it is used.

If you believe information we hold about you is inaccurate or incomplete, you may contact our Privacy Officer to request a correction.

13Safeguards

CLICKAD uses reasonable administrative, technical and organizational safeguards appropriate to the sensitivity of personal information under our control.

These safeguards are intended to protect information against risks such as:

  • unauthorized access;
  • unauthorized use or disclosure;
  • copying;
  • alteration;
  • loss;
  • theft; and
  • destruction.

Measures may include appropriate access controls, passwords, system-security measures, restricted access to business systems and procedures governing the handling of personal information.

No website, electronic communication, cloud service or data-storage system can be guaranteed to be completely secure. CLICKAD therefore cannot guarantee absolute security.

14Privacy and Security Incidents

If a breach of security safeguards involving personal information occurs, CLICKAD will assess the incident and take reasonable steps to contain, investigate and address it.

Where required by applicable law, CLICKAD will:

  • report the breach to the appropriate privacy regulator;
  • notify affected individuals; and
  • notify another organization or government institution where legally required.

CLICKAD will maintain records relating to breaches of security safeguards where required by law.

15Your Privacy Rights

Subject to applicable law, you may request:

  • confirmation of whether CLICKAD holds personal information about you;
  • access to personal information we hold about you;
  • information about how the information has been used;
  • information about disclosures of your information where applicable;
  • correction of inaccurate or incomplete information; or
  • withdrawal of consent where processing is based on consent.

To make a privacy request, contact our Privacy Officer.

We may need to verify your identity before fulfilling a request.

Where PIPEDA applies, CLICKAD will respond within the periods required by that legislation, subject to lawful exceptions and permitted extensions.

Certain information may be withheld where applicable law permits or requires us to do so.

16Privacy Questions and Complaints

You may contact CLICKAD’s Privacy Officer with questions, concerns or complaints regarding our handling of personal information.

CLICKAD will acknowledge and investigate privacy complaints and inquiries in a reasonably prompt manner.

Where a complaint is justified, CLICKAD will take appropriate steps to address the issue and, where necessary, correct or revise its information-handling practices.

We will inform the complainant of the outcome of our review and of any additional recourse that may be available where appropriate.

17Children

CLICKAD’s website and commercial services are primarily directed toward businesses and adults.

We do not knowingly seek to collect personal information from children through our general website forms.

If you believe a child has provided personal information to CLICKAD without appropriate authorization, please contact our Privacy Officer.

This Privacy Policy applies to personal information handled by CLICKAD and does not govern independent third-party websites or services.

We encourage you to review the applicable privacy policies before providing personal information to third parties.

CLICKAD may update this Privacy Policy to reflect changes to:

  • our website;
  • services;
  • technologies;
  • service providers;
  • business practices; or
